Welcome to LYNQD. These Terms & Conditions (“Terms”) govern your access to and use of the LYNQD website, software, point-of-sale systems, payment processing services, and related products and services (collectively, the “Services”) provided by LYNQD (“LYNQD,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to be bound by these Terms.
1. Eligibility & Acceptance
You must be at least 18 years old and capable of forming a legally binding contract to use the Services. By using LYNQD, you represent and warrant that you meet these requirements.
If you are using the Services on behalf of a business entity, you represent that you have authority to bind that entity.
2. Description of Services
LYNQD provides:
Payment processing solutions
Point-of-sale (POS) systems
Software integrations and reporting tools
Payment gateway connectivity
Merchant account facilitation through acquiring bank partners
LYNQD is not a bank or financial institution, or payment processor. Payment processing services are provided through third-party payment processors, acquiring banks, gateways, and networks.
3. Merchant Responsibilities
You agree to:
Provide accurate, complete, and current business and financial information
Comply with all applicable laws, including payment network rules (Visa, Mastercard, etc.)
Maintain PCI compliance and safeguard cardholder data
Only process transactions for lawful goods and services
You are solely responsible for:
Your products/services
Customer disputes and refunds
Chargebacks and fraud
Tax reporting and compliance
4. Prohibited Use
You may not use LYNQD for:
Illegal or fraudulent transactions
High-risk or restricted industries without approval
Money laundering or deceptive practices
Processing transactions on behalf of third parties without authorization
LYNQD reserves the right to suspend or terminate accounts engaging in prohibited activity.
5. Fees & Pricing
Fees for Services may include, but are not limited to:
Transaction fees
Monthly service fees
Hardware costs
Chargeback fees
Point-of-sale Fees
Early termination fees (if applicable)
All fees will be disclosed in your point of sale or merchant agreement or pricing schedule.
LYNQD reserves the right to update pricing with notice.
6. Payment Processing & Settlement
Transactions are processed through third-party payment processors and acquiring banks
Settlement timing depends on processor, bank, and risk review
By decision of 3rd party institutions, funds may be delayed, held, or reserved based on risk, compliance, or disputes
LYNQD is not responsible for delays caused by processors, banks, or card networks.
7. Chargebacks & Disputes
You are responsible for:
All chargebacks and retrieval requests
Associated fees and penalties
Providing documentation for dispute resolution
LYNQD may assist but does not guarantee successful dispute outcomes.
8. Hardware & Equipment
If you use LYNQD-provided hardware:
You are responsible for proper use and care
Devices must not be tampered with or modified
Lost or damaged equipment may incur replacement fees
9. Third-Party Services
LYNQD integrates with third-party providers, including:
Payment gateways
Acquiring banks
Accounting software
POS integrations
We are not responsible for:
Third-party outages
Data inaccuracies
Changes to third-party services
10. Data & Privacy
Your use of the Services is also governed by our Privacy Policy.
You agree:
Not to store sensitive payment data unless PCI compliant
To protect customer information
That LYNQD may process and store data as necessary to provide Services
11. Intellectual Property
All LYNQD software, branding, and systems are owned by LYNQD LLC or its licensors.
You are granted a limited, non-transferable, non-exclusive license to use the Services.
You may not:
Copy, modify, or reverse engineer the platform
Resell or sublicense without authorization
12. Account Suspension & Termination
LYNQD may suspend or terminate your account if:
You violate these Terms
You engage in risky or prohibited activity
Required information is not provided
Directed by a payment processor, bank, or regulatory authority
You may terminate your use of the Services at any time, subject to any contractual obligations.
13. Limitation of Liability
To the maximum extent permitted by law:
LYNQD shall not be liable for:
Indirect, incidental, or consequential damages
Lost profits or revenue
Data loss
Processor or bank-related interruptions
Total liability shall not exceed the fees paid to LYNQD in the preceding 3 months, unless otherwise agreed to with the Merchant Processing Application or LYNQD/Next Choice Point of Sale Agreement.
14. Indemnification
You agree to indemnify and hold harmless LYNQD from any claims, damages, or losses arising from:
Your use of the Services
Your business operations
Violations of law or these Terms
15. No Warranty
Services are provided “as is” and “as available.”
LYNQD makes no guarantees regarding:
Uptime or uninterrupted service
Approval of transactions
Processor or bank decisions
16. Compliance & Monitoring
LYNQD may:
Monitor transactions for fraud and compliance
Report suspicious activity as required by law
Request additional documentation at any time
17. Changes to Terms
We may update these Terms at any time. Continued use of the Services constitutes acceptance of the revised Terms.
18. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
